General Terms and Conditions of Use

1. Scope

These Terms of Use ("Terms") govern the use of the Software-as-a-Service platform Scape It, offered by
Scape It UG (haftungsbeschränkt), Luckeblick 14, 79589 Binzen, Germany ("Scape It", "we", or "us").

By registering or using Scape It, you agree to these Terms.

2. Description of Services

Scape It provides a cloud-based software solution accessible via a web browser.

There are:

  • a free version with limited functionality ("Free Version")
  • a paid version with extended functionality ("Pro Version")

The Pro version is available in the following pricing plans:

  • Project Pass: 2-month term.
  • Annual Subscription: 12-month term with automatic renewal.

The current features are described on our website. We reserve the right to modify the functions of the Free or Pro Version where reasonably acceptable for users.

3. Registration and User Account

To use Scape It, you must create a user account.
You are required to provide accurate information during registration and keep your login credentials confidential.

User accounts may not be transferred to or shared with third parties.

4. Contract Formation and Term (Pro)

  1. The paid use ("Pro Version") is handled through our authorized reseller Paddle, which acts as the Merchant of Record. Depending on the customer's region, this is Paddle.com Inc. (for sales to customers in the US), Paddle Payments Ltd. (for EU/international), or Paddle.com Market Ltd. (for international/distributed products).
  2. The purchase agreement for the subscription is concluded between you and the relevant Paddle entity. Paddle is responsible for payment processing, invoicing, and collecting due amounts.
  3. The use of the Scape It software itself is based on these Terms of Use between you and Scape It UG ( haftungsbeschränkt).
  4. The general terms and privacy policy of Paddle apply in addition to these Terms, available at https://www.paddle.com/legal/terms.
  5. After successful payment, you will gain access to the Pro Version. The ProjectPass expires automatically after 2 months. The annual subscription is valid indefinitely and can be canceled at any time at the end of the current billing year.
  6. After cancellation, your account will automatically revert to the Free Version.

5. Prices and Payment Terms

  1. The current prices for the Pro pricings are listed on our website.
  2. Billing occurs immediately after completing the purchase through Paddle.
  3. In the event of non-payment or chargeback, we reserve the right to suspend access to the Pro subscription until the issue is resolved.

6. Right of Withdrawal

7. User Obligations

You may use Scape It only in accordance with applicable laws and these Terms.

Uploading or distributing content that is unlawful, discriminatory, offensive, or infringes on copyrights is prohibited.

We reserve the right to suspend or delete user accounts in case of violations.

8. Availability and Changes

We strive to ensure high availability of Scape It, but cannot guarantee uninterrupted service.

We reserve the right to modify, expand, or discontinue the platform or individual features where reasonably acceptable for users.

9. Liability

  1. Scape It UG is fully liable for intent and gross negligence.
  2. In cases of slight negligence, Scape It UG is liable only for breaches of essential contractual obligations (cardinal duties) and only for foreseeable, typical damages.
  3. Any further liability is excluded to the extent permitted by law.
  4. Liability under the Product Liability Act and for injury to life, body, or health remains unaffected.
  5. If Scape It discontinues the service for any reason, there shall be no entitlement to a refund of amounts already paid or to compensation, regardless of the subscription term (e.g., annual subscription or ProjectPass). This also applies if the service is discontinued during an ongoing subscription period.

10. Data Protection

Protecting your data is important to us.

The processing of personal data is carried out in accordance with our Privacy Policy.

11. Termination and Account Deletion

You can delete your account at any time in your account settings.
If you have an active Pro subscription, you must first cancel it before you can delete your user account.

After deletion, your personal data will be erased or anonymized in accordance with legal retention requirements.

12. Final Provisions

  1. The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. The place of performance and jurisdiction, where legally permissible, is the registered office of Scape It UG.
  3. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
